Some states allow you to double dip. (e.g. - if you have med insurance, you can get your med bills paid by your own med insurance, and then you can collect from the offending party for your med bills).
However.. if you pursue this route, expect this stuff to be drawn out for years, since the defense has more incentive to see you "well" in court 2 years later than for you to show up with a concussion/whiplash 1 month later. In addition, during this extended time frame, you will have to go to a doctor quite a bit to get medical records, etc. So expect to spend a lot of time at a doc's office (or a chiropractor, if you can stomach those).
To be blunt, your chances of getting 50k for minor-injuries are not very good, esp. after the lawyer will take (on average) about 1/3rd of the take.
If the offending party offers a settlement, take it, because it does not seem like your injuries are that severe.. unless you can establish a pattern for going back into the doctor's repeatedly for your whiplash/concussion.
